Paysoft is dedicated to streamlining payments and driving growth for merchants across Pakistan. By accessing or utilizing our payment gateway and software development services, you agree to comply with the terms and conditions set forth below. These terms establish a legally binding agreement between you (the “Merchant” or “User”) and Paysoft.
User Obligations
As a user of Paysoft’s platform, you agree to:
- Use our services responsibly, in compliance with all applicable Pakistani laws and regulations.
- Avoid any activity that could harm Paysoft’s reputation, interfere with the platform’s functionality, or jeopardize its security.
- Refrain from attempting to alter, disassemble, decompile, or reverse-engineer Paysoft’s systems without prior written permission.
- Provide accurate, complete, and up-to-date information during account registration and comply with all “Know Your Customer” (KYC) requirements as mandated by Paysoft.
- Notify Paysoft promptly if there are any unauthorized transactions or suspected security breaches in your account.
Failure to comply with these obligations may result in the suspension or termination of your account and services.
Merchant Obligations
Merchants utilizing Paysoft’s services are required to:
- Operate in compliance with all relevant laws, regulations, and industry standards applicable within Pakistan.
- Ensure that all transactions processed via Paysoft are genuine and conducted with the authorization of the customer.
- Protect customer data and prevent unauthorized access by implementing robust security measures, including encryption where necessary.
- Notify Paysoft of any changes in your business, including changes to the types of products or services being offered, website URLs, or the nature of your operations.
- Retain transaction records and relevant documentation for a minimum of five (5) years to comply with regulatory requirements and resolve potential disputes.
- Handle customer refunds, disputes, and complaints in a professional and transparent manner in alignment with applicable laws and your business policies.
Merchants are prohibited from using Paysoft’s services for:
- Processing transactions related to illegal or prohibited goods and services, including firearms, explosives, drugs, pornography, or gambling.
- Conducting fraudulent or unauthorized transactions.
- Surcharging customers for using specific payment methods.
Transactions and Settlements
Paysoft ensures that settlements for successfully processed transactions will be carried out within the agreed timelines.
- In case of unforeseen delays (e.g., technical issues or compliance reviews), Paysoft will communicate the reason for the delay and provide an updated timeline.
- Merchants are expected to maintain accurate transaction data and ensure compliance with our operational policies.
- Paysoft reserves the right to withhold or recover funds if there is any fraudulent activity, chargeback, or regulatory concern associated with a transaction.
Refund Policy
Refunds for payments processed through Paysoft’s gateway must be handled by the merchant directly with their customers. Paysoft does not facilitate refunds but will provide the necessary transaction data to assist merchants. Refunds for Paysoft’s subscription, setup, or integration fees are not applicable.
Confidentiality and Data Security
Merchants and users must uphold the confidentiality of sensitive customer and transactional data. This includes but is not limited to:
- Preventing unauthorized access to customer information collected during transactions.
- Ensuring that payment data is securely transmitted and stored, adhering to the highest industry standards.
- Implementing adequate safeguards to prevent breaches or leaks.
Paysoft is not responsible for losses or damages arising from security lapses caused by negligence on the part of the merchant.
Prohibited Activities
Merchants must not use Paysoft’s platform to process payments for:
- Illegal or prohibited goods or services under Pakistani law.
- Any activity that involves fraud, money laundering, or financing of unlawful operations.
Examples of prohibited activities include:
- Sale of banned substances or materials (e.g., drugs, explosives).
- Pornographic content or gambling-related services.
- Hazardous or prohibited goods as outlined under Pakistani law.
Engaging in such activities will result in immediate suspension of services and legal action.
Disputes and Chargebacks
In case of disputes between merchants and customers, Paysoft acts solely as an intermediary and is not liable for resolving disputes over product quality, delivery, or refunds.
- Chargebacks, if initiated by customers, will be notified to the merchant.
- Paysoft reserves the right to recover chargeback amounts from the merchant’s account or settlements.
- Merchants are responsible for providing proof of delivery or transaction authenticity within the stipulated time to dispute chargebacks.
Intellectual Property
The Paysoft brand, including but not limited to its logos, trademarks, and proprietary content, is protected by intellectual property laws.
- Merchants may not use Paysoft’s branding without prior written approval.
- Unauthorized copying, modification, or distribution of Paysoft’s platform, systems, or related content is strictly prohibited.
Limitation of Liability
Paysoft provides its services on an “as is” basis and does not warrant uninterrupted or error-free operations.
- Paysoft is not liable for any direct, indirect, incidental, or consequential damages arising from the use of its services, including delays, system errors, or data breaches caused by third parties.
- Users and merchants acknowledge that they assume full responsibility for the use of Paysoft’s platform.
Governing Law and Jurisdiction
These terms and conditions are governed by the laws of Pakistan. Any disputes or legal claims will fall under the exclusive jurisdiction of the courts in Pakistan.
